9. Artist's Original Music Consent and Release Form

RADIO BROADCAST / RECORDING AGREEMENT

This Agreement is entered into between NextWave Radio Group / NextWave
Broadcasting Network and the Artist, Band, Recording Company, Copyright
Owner, or authorized representative identified in this submission.

This Agreement concerns promotional music use and the mutual covenants
described below.

SECTION I — LEGAL UNDERSTANDING AND REPRESENTATIONS

This authorization is required for music submitted for consideration for
broadcast through NextWave-affiliated radio stations, including New Wave Radio,
Rock 'n Roll Radio, The Alternative One / Alternative Modern Rock Radio,
Wild Country Radio and Yacht Rock Radio, together with related applications,
websites, internet streams, promotional programming and podcasts.

The Artist, Band, Recording Company or Copyright Owner submitting the material
grants NextWave Radio Group / NextWave Broadcasting Network and its affiliated
stations, licensees, assigns, programs and designees the authorizations
described in this Agreement.

SECTION II — WARRANTIES AND REPRESENTATIONS

The Stations represent that promotional recordings of the Artist's performance
are intended for promotional broadcasting through NextWave-affiliated radio
stations and services.

Copies of recordings embodying the Artist's performance shall not be licensed,
leased or sold to another person, company or entity for purposes unrelated to
the authorized promotional radio broadcast use contemplated by this Agreement.

Recordings provided by the Artist, including digital audio, MP3, CD, tape,
vinyl or other formats, together with the performances embodied in those
recordings, remain the property of the Artist or appropriate rights holder,
subject to the promotional broadcast rights granted under this Agreement.

NextWave may create technical or promotional reproductions necessary for
radio stations, news media, websites, applications, streams, podcasts and
other authorized promotional broadcasting uses.

SECTION III — PLAY / RECORDING AUTHORIZATION

The purpose of this Agreement is to authorize broadcasting of the Artist's
submitted music through NextWave-affiliated radio stations and promotional
platforms.

The Artist grants NextWave the non-exclusive right to use the Artist's name,
artist or band photographs, likeness, logo and biographical material in
connection with advertising, identifying and promoting the Artist's appearance,
music and programming on NextWave radio stations and related platforms.

I authorize NextWave Broadcasting Network and its affiliated stations and designees to play my submitted original music on radio stations, websites, applications, internet streams and podcasts, and to use excerpts where appropriate in station news, programming and promotional productions.

SECTION IV — TERM OF AGREEMENT

This Agreement is non-exclusive. The Artist retains the right to perform,
record, distribute and license the Artist's music to other persons,
organizations, broadcasters, platforms or companies.

The Artist grants the broadcast license described in this Agreement for a
period of two (2) years from the date the Agreement is executed.
The Agreement may be extended for an additional two (2) years when mutually
agreed upon by the Artist and NextWave.

Any extension or renewal must be mutually agreed upon and communicated in
accordance with the Agreement.

10. Server Copy & Technical Reproduction Authorization

The Artist / Copyright Owner authorizes NextWave to copy the submitted sound
recordings and musical compositions to NextWave-controlled servers and systems
as reasonably necessary to facilitate transmission of the recordings from
station systems to listeners.

I authorize the technical copying and storage of my submitted recording as necessary to facilitate authorized broadcasting and streaming.

11. Promotional Platforms & Associations

The authorization includes use through NextWave-affiliated radio programs,
station websites, applications, internet streams, podcasts and related
promotional events associated with NextWave-affiliated radio stations.

12. Compensation / Promotional Broadcast Understanding

The submitted music is being provided under this Agreement for promotional
broadcast use. The Artist acknowledges the compensation and licensing
provisions contained in this Agreement regarding the transmissions and
reproductions authorized by the Artist.

13. Ownership & Authority

The Copyright Owner represents and warrants that the Copyright Owner possesses
the authority necessary to grant the rights contained in this Agreement,
including applicable copyright, trademark, performance, musical composition
and sound-recording rights.

The Copyright Owner represents that the submitted work is original and has
not been submitted as an unauthorized cover, borrowed recording or musical
composition belonging to another party.

If an independent record label controls rights necessary for this authorization,
an authorized representative of that label must also approve the submission
and Agreement.

14. Indemnification

The Copyright Owner agrees to indemnify and hold harmless NextWave Broadcasting
Network / NextWave Radio Group, its affiliated stations, officers, directors,
employees, agents and assigns from claims, fees, penalties, liabilities,
losses, damages and reasonable legal expenses arising from unauthorized
reproduction, transmission, retransmission or distribution of submitted
recordings, compositions, trademarks or other intellectual property when such
claims result from rights or materials supplied or represented by the
Copyright Owner.

15. Promotional Name, Image & Artwork Authorization

The Copyright Owner grants NextWave the right to use, transmit and display,
in connection with authorized broadcasts and promotions, the name of the
recording, musical composition, composers, performers and any supplied logo,
biographical information, album graphics, promotional artwork and photographs.

I authorize the promotional use of the artist/band name, song title, biographical information, photographs, logos and supplied artwork in connection with my music and NextWave programming.

16. Limitation of Liability

The Agreement supplied by NextWave provides that neither party's liability
to the other arising from or relating to the Agreement will exceed $50 and
contains limitations concerning consequential, indirect, special, incidental
and punitive damages.

17. Arbitration

The Agreement provides that controversies or claims arising out of or relating
to the Agreement or its breach are to be settled by arbitration in the State
of Florida under the applicable commercial rules referenced in the Agreement.

18. Governing Law & Jurisdiction

This Agreement is governed by applicable United States and Florida law as
described in the Agreement. The Agreement provides for jurisdiction in
Palm Beach County, Florida for applicable disputes involving the Agreement.

19. Submitted Recording Coverage

Where an MP3, album, CD, tape, record or other identified release contains
multiple recordings and is expressly submitted under this Agreement, the
Agreement provides that the submitted recordings identified as part of that
release are covered by the authorization.

20. Entire Agreement

This Agreement constitutes the agreement between the parties regarding the
rights and authorization described herein and supersedes prior oral or written
understandings concerning those matters.

21. Binding Effect

The Agreement is binding upon and benefits the respective parties and their
permitted successors and assigns, subject to its terms.

22. Severability

If any portion of this Agreement is found invalid or unenforceable, the
remaining provisions are intended to remain in effect to the extent permitted
by applicable law.

10. Final Artist Certifications

I certify that I have read the entire Artist's Original Music Consent and Release Form / Radio Broadcast Agreement presented above.

I understand the terms and conditions of this Agreement and have had the opportunity to seek independent legal advice before signing.

13. $25 Artist Setup / Administrative Fee

For approved submissions, NextWave Broadcasting Network currently charges a
one-time $25 artist setup and administrative fee associated
with preparing the artist and approved song for station programming,
administrative processing, website/mobile setup where applicable, and
supporting the staff and interns involved with the emerging-artist program.

Payment of the setup fee does not guarantee permanent rotation, future
airplay, chart position, listener response, commercial success or continued
promotion.

I understand the $25 setup/administrative fee and understand that payment does not guarantee continued airplay or commercial results.
